What's All The Buzz About Tax Sale Overages?

There has been a lot of buzz lately about getting finder fees from tax sale overages.

I've been getting a few questions about this new way to make money from tax sale properties without going to the tax sale and without having to purchase anything.

But this in not a new strategy, it's been around for quite a while. In fact I've hosted a couple of webinars with Rick Dawson about this strategy in the last couple of years.

Rick's students have been receiving big checks each month for finding people that are owed excess proceeds from tax sales, and helping them get their money. He found this strategy to be even more profitable than his DeedGrabbing strategy of buying properties cheap from the owner before the tax sale because:

1) You don't have to own property
2) You don't need to have much money
3) You don't have to fix up and sell properties
4) You don't have to do any due diligence on properties

The only problem is that Rick's course has not been available for a while. The thing is this; how much money you can pay for a tax lien or a tax deed and still make a good profit on your investment depends on the value of the property. Learn How To Invest in the States with the Highest Return

Georgia and Texas are redeemable deed states. What makes them so attractive to tax lien investors are the high interest rates and shorter redemption periods. However in Texas and Georgia in order to redeem the deed the delinquent tax payer must pay the penalty on the total amount the investor paid for the deed. So the investor gets his or her original investment back plus 20% (in Georgia) or 25% (in Texas).

The drawback to investing in these states is that they do not have online tax sales. While you have to physically show up at the tax sale, or have an agent show up for you, you can do most of your due diligence online for the properties in the tax sale. You do have to have someone physically bid for you at the tax sale, but it doesn't have to be you that does the bidding.

Another way to participate in these tax sales without traveling to Texas or Georgia is to use a tax lien investing agent who specializes in investing in these states.

These are most but not all of the questions that I’ve received so far. They are the questions that I’ll be able to get to on tonight’s call. There was one very basic but very important question that I don’t want to take the time to answer tonight, though. I do want to answer it for you right now. That question is, “What is a tax deed and what is the difference between a tax deed and a tax lien?”

When you purchase a tax lien, you are not purchasing the property, but paying the taxes and recording a lien on the property. You do not have any rights to the property. The property owner has an obligation to satisfy your lien, which means they have to pay the amount of the liens plus the interest and penalties that have accrued at the time of redemption. If they do not satisfy the lien within the redemption period, which is specified by the state and sometimes by the county, then you can foreclose on property in order to satisfy your lien.

Which Lien State Has the Highest Interest Rate?

One of the most frequent questions that I get is: "Which state has the highest interest rate for tax lien investing?" The answer is Illinois. Illinois has a default interest rate of 18%, but it's not 18% per annum - it's 18% per six months. So the per annum rate is 36%. That's higher than and of the other tax lien states. The interest rate is bid down at the tax sale, and except for Cook county, which started conducting online tax sales last year, you have to physically go to the sale in order to bid.

Bob showed us some examples of how he used real estate timing statistics to make a lot more money in his real estate investing than the average investor. He showed examples from three different area of the country and showed us how real estate market timing works.

In the teleseminar that I did on last Thursday on Finding the Best Place for You to Invest in Tax Liens or Tax Deeds, someone had asked about the redemption period and interest rates in Georgia. Georgia is a redeemable deed state, and I didn't have all the particulars for that state readily available. I decided to put that information here on this blog so that everyone who registered for the teleseminar can read it. Below is an excerpt from my State Guide about Georgia tax sales. The blue link is a link to the NACO.org web site for Georgia, and from that site you can access the county tax collectors web page.

Georgia

Georgia is a redeemable deed state. Georgia sells deeds with a one year right of redemption and a 20% penalty for the first year or fraction thereof. After the first year the deed purchaser is entitled to an additional 10% penalty for each subsequent year or fraction of a year until the lien is redeemed. In Georgia, the County Tax Commissioner is responsible for conducting tax sales for the collection of unpaid taxes. Tax sales are advertised for four consecutive weeks in the legal section of the county newspaper. Some counties hold tax sales every month. The opening bid is equal to the amount of taxes due plus costs of the sale. Properties are sold to the highest bidder. If no one bids over the opening bid, the property will be "bid in" for the county. Most counties require payment for the amount of the bid at the time of sale in cash, money order, or certified funds. If the highest bidder fails to or refuses to comply with the terms of sale, the property may be resold and the first bidder held responsible for any deficiency arising from the latter sale. Once the tax sale is concluded and the high bidder fulfills their obligation to pay, the tax commissioner issues a tax deed to the purchaser. The tax deed is not a warranty deed. It is up to the purchaser to check the validity of title to the property. The purchaser will be responsible for property taxes as they become due. The amount of any tax paid, however, may be added to the redemption price. After the one year redemption period is over, the purchaser of the deed must take legal steps to close the right of redemption in order to obtain the property. There are 159 counties in Georgia, they do not all have tax information online but some of the larger counties have both assessment information and tax sale information online.
